Terms of Service

These Terms govern your use of FRIXIA (frixia.ai), a content protection service for creators. By creating an account or using the Service you agree to these Terms.
1. Who we are
FRIXIA is operated by Lorenzo Frisoni, Italy ("FRIXIA", "we"). Contact: legal@frixia.ai.
2. The Service
FRIXIA provides: (a) automated monitoring of public websites for unauthorized copies of your content ("Shield"); (b) private storage of original files and forensic watermarking as evidence of ownership ("Vault"); (c) assisted generation and delivery of copyright takedown notices, including notices under the U.S. Digital Millennium Copyright Act ("DMCA") and equivalent laws ("Defense"); and (d) email notifications about newly detected matches.
The Service is a tool. It does not provide legal advice and is not a law firm.
3. Eligibility and your account
You must be at least 18 years old. You are responsible for the accuracy of the information in your account and for keeping your credentials secure. One account per person or legal entity unless otherwise agreed.
4. Subscription, trial and billing
The Service costs €49 per month, with a 14-day free trial for new accounts. Payments are processed by Stripe; we never store your card details.
Subscriptions renew automatically each month until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Amounts already paid for a started period are not refunded, except where required by mandatory consumer law.
We may change prices with at least 30 days notice; changes apply from your next renewal.
5. DMCA agent authorization
By entering your legal details (legal name, contact email, postal address) in Settings and using the "Generate DMCA" feature, you appoint FRIXIA as your authorized agent for the sole purpose of preparing and sending copyright takedown notices on your behalf under 17 U.S.C. § 512(c)(3) and equivalent laws.
Each time you generate a notice you confirm that: (a) you are the owner of the rights in the content concerned, or are authorized to act on the owner's behalf; (b) you have a good-faith belief that the reported use is not authorized; and (c) the information you provided is accurate. These statements are made under penalty of perjury where the applicable law so requires.
You are responsible for reviewing detected matches before sending a notice. Liability for knowingly material misrepresentations in a notice (including under 17 U.S.C. § 512(f)) rests with you.
6. No guarantee of removal
Detection is automated and may produce false positives or miss infringing copies. Removal depends on third parties (hosts, platforms, search engines) that we do not control. We provide the Service on a best-effort basis and do not guarantee that any specific content will be found or removed, or any specific timeframe.
7. Acceptable use
You may only use the Service to protect content that you own or are authorized to manage. You must not use the Service to target lawful content, to harass any person, to send notices you know to be false, or to interfere with the operation of the Service. You must not resell, reverse engineer or scan the Service without our written consent.
We may suspend or terminate accounts that violate this section.
8. Your content
You retain all rights to the files you upload. You grant us a limited license to store and process them solely to provide the Service (e.g. private storage, watermark analysis, attaching evidence to notices). Uploaded originals are stored in a private bucket and are never made public by us.
9. Our intellectual property
The FRIXIA name, logo, software and site content are owned by us or our licensors. These Terms do not grant you any rights to them beyond use of the Service.
10. Privacy
Our processing of personal data is described in the Privacy Policy at frixia.ai/privacy.
11. Disclaimer and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties and our total liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages, loss of profits, or loss of data.
Nothing in these Terms limits liability that cannot be limited by law, including mandatory consumer rights.
12. Indemnity
You will indemnify us against claims by third parties arising from notices sent on the basis of your instructions or certifications, or from your breach of these Terms.
13. Termination
You can delete your account at any time from Settings; this purges your data as described in the Privacy Policy. We may suspend or terminate the Service for material breach of these Terms, with notice where practicable.
14. Governing law
These Terms are governed by Italian law. Disputes are subject to the jurisdiction of the Italian courts, without prejudice to mandatory consumer protections of your country of residence.
15. Changes to these Terms
We may update these Terms; material changes will be notified by email or in the app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
